Terms of Service

By creating an account or using any part of the Service, you confirm that you are at least 13 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

MoneyKiss is a personal finance management application that allows users to track income and expenses, set budgets, create savings goals, and view analytics about their financial habits. The Service is provided for personal, non-commercial use only.

MoneyKiss is a financial tracking tool only. We are not a bank, financial institution, investment advisor, or licensed financial service provider. Nothing in the Service constitutes financial, investment, tax, or legal advice. Always consult a qualified professional for such guidance.

To use the Service, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

We reserve the right to terminate accounts that violate these Terms or remain inactive for an extended period, with reasonable notice.

You agree to use the Service only for lawful purposes. You may not:

• Use the Service for any illegal or fraudulent purpose
• Attempt to gain unauthorized access to any part of the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Upload or transmit malicious code, viruses, or disruptive content
• Impersonate any person or entity
• Resell or sublicense access to the Service
• Violate any applicable local, national, or international law or regulation

We reserve the right to suspend or terminate your access for any violation of this section without prior notice.

You retain ownership of all financial data and content you enter into the Service. By using the Service, you grant us a limited, non-exclusive license to store and process your data solely to provide the Service to you.

You are responsible for the accuracy of the data you enter. MoneyKiss is not liable for decisions you make based on data displayed in the app.

You may export or delete your data at any time through the app settings. Upon account deletion, we will remove your data from active systems within 30 days, subject to legal retention requirements.

MoneyKiss may offer free and premium subscription tiers. Premium features require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected).

All fees are in USD unless otherwise stated. Prices may change with 30 days' notice. Continued use after a price change constitutes acceptance.

Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription through the App Store or Google Play account settings. Refunds are subject to the respective platform's refund policy.

We do not offer refunds for partial subscription periods, except where required by law.

The Service and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of MoneyKiss and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy or completeness of any information provided through the Service.

MoneyKiss is not responsible for any financial decisions you make based on information displayed in the app. All financial tracking data is as accurate as the information you provide.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MONEYKISS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $50, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless MoneyKiss and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

You may stop using the Service and delete your account at any time through the app settings or by emailing us at [email protected].

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

Sections 7, 8, 9, 10, and 13 of these Terms survive termination.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this page and, where appropriate, by sending an email notification.

Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against MoneyKiss.
